Judge Kenneth Bell found insufficient evidence that Elsevier knowingly published false statements or recklessly disregarded their truth. GPS Air’s attorney says the company expects to appeal.
The U.S. District Court for the Western District of North Carolina dismissed Global Plasma Solutions’ defamation case against Elsevier on 22 October 2026, finding the evidence too weak to take to trial. Retraction Watch described the ruling in an article published on 28 October.
The air-quality products company, now called GPS Air, sued in 2022 after Elsevier declined to retract a paper in its journal Building and Environment. The dispute concerned the company’s needlepoint bipolar ionization technology, used in its air-purification system.
The disputed 2021 paper concluded that the company’s ionizer had minimal effect on indoor air quality and posed a risk of generating dangerous irritants. Those were the researchers’ findings, not an independent assessment of the technology by the court.
GPS Air alleged that the researchers suppressed and distorted evidence, including test results suggesting the technology was effective. It alleged that Elsevier was responsible for omitted data and misleading conclusions that caused major financial losses.
Judge Kenneth Bell found insufficient evidence of “actual malice.” That legal standard required GPS Air to show that Elsevier knew an allegedly defamatory statement was false or acted with reckless disregard for its truth.
Bell concluded that the paper’s results were neither fabricated nor fraudulent, but accurate averages of actual experiments. He nevertheless expressed concern that the authors had not disclosed the averaging and had not made the underlying data available to readers. The missing data may have affected readers’ ability to assess the findings, he said.
The European Commission said on 30 October that Canada–EU digital trade negotiations had ended, with formal signature still ahead. Canada separately signed an investment framework with the European Investment Bank; individual financing requires approval.
The court also rejected GPS Air’s false-advertising claim over Elsevier’s description of its journals as peer reviewed—meaning assessed by other qualified researchers before publication. Bell found that the disputed paper had undergone that process and that a reasonable jury could not find the advertisements false or misleading.
GPS Air attorney Robert Muckenfuss said the company was evaluating the order and expected to appeal. He maintained that there was adequate evidence of malice.
Bell also ordered both parties to refile, without redactions, all memoranda and exhibits submitted for the court’s decision on whether the case could proceed to trial.
